When a brass band is arranging their insurance, the key covers which are usually purchased are for their instruments (and other contents), and Public Liability insurance in the event a member of the public becomes injured during a performance.
However, most bands decline to include Employers' Liability cover as they believe this is something they do not need. Why should they need Employers' Liability cover when they don't have any employees?
Unique position
Employers' Liability insurance occupies a unique position in the insurance market, as it is a one of very few policies which are a legal requirement.
Any company or organistation which has official PAYE employees or people operating under it's instruction and control must hold such a policy. However, it can also be a crucial cover for bands.
If a member severely injures themselves at rehearsal and claims against the band, would this be covered? It would not be covered under the instrument section, and it would not be covered under the Public Liability section as a band member is not classed as a member of the public.
Liable?
If the organisation is found to have been negligent in a way which caused the accident, they could be liable to pay any compensation awarded to the member or the member's family.
This is where Employers' Liability cover would come in. Despite the fact that they are not PAYE employees, anyone carrying out tasks under the direction of the band or organisation, even as little as being told where to stand during a performance, could classify them as an employee and therefore leave the band exposed to potential claims.
