The legal action case challenging the imposition of charges for musical instrument tuition in Scotland has taken its first steps.
It is being led by lawyer and bandsman Ralph Riddiough backed by £15,000 of crowdfunding support and is seeking to confirm that local authorities are in breach of the 1980 Education Scotland Act in imposing the fees.
Mr Riddiough has lodged a complaint with the Scottish Government aimed at clarifying the position, which at present sees the majority of Scotland's 32 local authorities having fee structures for peripatetic services.
Free of charge
He believes he is backed by the findings of a recent Scottish Parliament Education and Skills Committee report which started that it was their finding that instrumental music tutors should be considered to be part of core education provision, and therefore free of being charged.
It was reported in 'The Herald' newspaper that the Scottish Government confirmed that Mr Riddiough' Section 70 complaint had been received and said that it would be 'considered it in accordance with the relevant procedure'. The Government has until January to issue its response.
